The most effective way to avoid probate for California real estate is to hold the property in a revocable living trust. When property is properly titled in a trust, it transfers to beneficiaries upon the grantor's death without court involvement. Other methods include joint tenancy with right of survivorship (property transfers automatically to the surviving joint tenant), community property with right of survivorship (available to married couples in California), and beneficiary deeds (also called transfer-on-death deeds, which allow real property to transfer directly to a named beneficiary without probate).
A revocable living trust is generally considered the most comprehensive approach because it provides the most control and flexibility during the grantor's lifetime while avoiding probate at death. The critical requirement is that property must actually be transferred into the trust — the deed must be changed to name the trust as owner. A trust that has not been properly funded with the property provides no probate avoidance benefit for that property.
